National Rail Safety regulator one step closer


The rail industry is actively engaging in the state and Commonwealth Government project to establish the National Rail Safety Regulator in Adelaide by 1 January 2013.
 
With offices around Australia, the new regulator will replace the current regime of separate state and territory regulators.
 
This project is being managed by Julie Bullas, project director National Rail Safety Regulator Project Office, in conjunction with the NTC, based in Adelaide. She is accountable to the project board comprising senior representatives from all governments.
Draft national legislation is to be approved by April 2011 in order to enable all the sates to enact the necessary legislation in time for the operational deadline of 1 January 2013.
 
The Australasian Railways Association (ARA) is coordinating the rail industry input into the draft legislation in a similar manner to the industry’s engagement with the previous process that developed the Model Rail Safety Bill.
 
The key mechanism to enable this input will be to utilise a small working group (ARA Rail Safety Regulator Working Group) comprising senior representatives from major operators (Queensland Rail, Asciano, ARTC and RailCorp).
 
Advice to the RSR Working Group will be provided by Australia Tourism & Heritage Rail Association (ATHRA) for the Heritage sector and Laing O’Rourke for the wider construction and maintenance sector.
 
Furthermore, members of the ARA and Rail Industry Safety & Standards Board (RISSB) Safety Managers Group will continue to provide advice to working group
 
The ARA Rail Safety Regulator Working Group will formulate policy positions as necessary, based on the underlying policy that the ARA Executive approved in the development of the model bill and regulations and subsequent legislation adopted in the jurisdictions.
 
Where clarity or approval is needed in this process the ARA executive will be asked to provide direction or approval as necessary, and the ARA will continue to provide updates to the Industry’s Safety Managers Group.
 
The ARA process will be managed by the director government relations, Phil Sochon at the ARA.
